Notes: Archives 2012.004.0081 ==== Mayor's Office Hoboken, Dec 18, 1874 To the Honorable the Council of the City of Hoboken. Gentlemen I herewith return to your Honorable body without my approval the resolution directing the Street Commission to remove all obstructions from the Street line of Third Street between River Street and low water mark, or to speak more plainly to remove the buildings now used by the Bremen and Hamburgh [Hamburg] Steamship Company for warehouse and storage purposes. It was held by the Court of Errors and Appeals at the June (?) term of 1873, that by virtue of the dedication by the map of 1805, the right of the City to the Streets was extended to the new water front. That is high water mark by the filling in. Your resolution directs the Street Commission to open up the Street to low water mark, which would be illegal. It is now an understood fact that the City has the right to open streets to the River. No one that I know of denies us that right, and there is none more desirous than myself to have the City avail itself to the Same, in a manner which would be most beneficial to its interests. But the immediate removal of the above named buildings without any notification to the present owners, I am of the opinion that such hasty action on our part would be ill advised, and might perhaps invoke the City in further complications, for the reason Stated, and being somewhat doubtful as ot the legality of the course proposed by your resolution.
