Notes: Archives 2013.060.0011 BOARD OF EDUCATION. STATED SESSION. Stated session of the Board of Education, held at their rooms, School House No. 4, Monday evening, November 29th, 1880. Present — Trustees Beltz, Havens, Kennedy, Kiernan, Kerr, Reid, Tangemann, Ingleson, McCulloch and President Munson. Absent—Trustees Aunderson, and O'Brien. Ou motion of Trustee Kiernan, the reading of the minutes of the meeting, November 8th, 1880, was dispensed with and they were approved as printed. A requisition for supplies for the month ot December, 1880, was presented and on motion of Trustee Kiernan, referred to the Committee ou Supplies with power. The following opinion of Malcolm W. Niven, Corporation Attorney, on claim of A. W. Clayton, for repairs at School No. 3, was presented: Office of the Corporation Attorney, Hoboken, N.J. Nov. 26th 1880. To the Board of Education of the City of Hoboken: Gentlemen—I submit my views relative to the claim of A. W. Clayton, for extra work alleged to have been done by him at No 3 school house, with the preliminary statement that I went to school house No. 3 with Mr. Anderson and was shown by him the extra work, as alleged by Mr. Clayton, and had the matter explained so far as it lay in Mr. Anderson's knowledge. I also conferred with Mr. Reekie, the architect in charge. I also examined the plans and specifications for the work, and all the proceedings of your Board relative thereto, as they appear in the printed minutes then appointed a time for hearing all the various parties might have to say. Mr. Reekie, Mr. Clayton and Mr. Tanner attended. I desired to get the ideas of those who had bid upon the work, to know what construction was put by them upon the specification, the gentlemen attending stated their views fully. Mr, Reekie stated that the specification was intended to cover everything, but he frankly admitted that perhaps it was not clear to others. He stated that the demand, so far as amount was concerned, was not exorbitant, and if paid, would not make the total price paid at all unreasonable. If it was legal so to do. he rather favored the payment as just. I found that the only question to be considered was; Did the specifications make the work to be done, in all its items, so clear that the bidders had full notice? If they did not, then a recovery might be had against the city in a suit at law, and it would not be prudent to stand suit and pay the expenses. In my judgment, the specifications while probably clear to the architect who designed the work, wero not sufficiently clear and explicit in showing all details which were not shown on the plan. The paragraph which is claimed by the architect to cover the extra work claimed by Mr. Clayton, was incorporated in that portion of the specification referring to the finish of the wood work in the arches and around the windows; while on the other hand the section referring to the stairs and the finish thereof, makes no reference to the work done by Mr. Clayton. It seems to me it would have properly been placed under the latter heading, as it was a part of the finish of the stairway. It must be borne in mind that the specification was made by the employee of the Citv and would be therefore construed adversely to the city, if ft was not plain. Under all the circumstances of the case, I consider that the City would be at a disadvantage if sued, and therefore advise a fair settlement of the claim. Respectfully, Malcolm W. Niven, Corporation Attorney, Trustee Kiernan moved that the communication be received and the claim ordered paid. Lost by the following voter Ayes— Trustees Beltz, Kiernan, Kerr, Tangemann and McCulloch. Nays— Trustees Havens, Kennedy, Reid, Ingleson and President Munson. Absent—Trustees Anderson and O'Brien. On motion of Trustee Kiernan, the claim of A. W, Clayton was referred to the Committee on School Buildings and Furniture. On motion of Trustee Tangemann, the communication from the Corporation Attorney, was received. A communication from Mansfield and Fagan relative to claim against, A. W. Clayton, was presented and on motion of Trustee Tangemann, ordered on file. The resignation of Miss Mary Rue, as teacher, to take effect December 31st, 1880, was presented and on motion of Trustee Kiernan,received and resignation accepted. The following communication and affidavits were presented by Trustee Kiernan, and on motion of Trustee Havens, referred to the Committee of the Whole for action thereon, Wednesday evening, December 8th, 1880. To the Honorable the Board of Education: Gentlemen—Agreeable to your resolution passed at a meeting of your board held on November 8th, 1880, referring the matter concerning Miss Cunningham back to me for specific facts, I tender herewith for your consideration the affidavits hereto annexed. State of New Jersey,) County of Hudson, ) Mary Barnum, sixteen years of age, being duly sworn according to law, deposeth and saith, I live at 38 Monroe street in the City of Hoboken, I have often been invited to Miss Cunningham's house— sometimes as a guest, sometimes to receive information concerning mathematical or grammatical points. As a guest she has often offered me liquors, sometimes beer, and once she offered me a cigar. She also said it was unladylike to refuse anything offered by the hostess to her guests. Mary Barnum. State of New Jersey, ) Hudson County. ) Emily Archbold, sixteen years of age, being duly sworn according to law upon her oath, deposes and saith, I live at number 5 Paterson avenue, Hoboken, my teacher, Miss Cunningham, has repeatedly abused me at schiool she said to me among other things that I ought to go home and turn my back to my parents. State of New Jersey,) Hudson County,) ---- Mary Barnum, sixteen years of age, being duly sworn according to law upon her oath, deposes and saith, that she lives at number 38 Monroe street, in the City of Hoboken, that she attended school at number 3 School under Miss Cunningham teacher, that during the January, 1880, term of school, she the said Miss Cunningham made very unladylike and abusive expressions towards the class in general, and her, the said Mary Barnum, in particular, to wit: In reflecting on the class she said: "imparting knowledge to you is like casting pearls before swine." " You appear as coming irom Green or Baxter street." " You are the scum of the meadows." These expressions she made use of very frequently. In reference to myself she often told me, " what are we to infer from you, your father is living out West and your mother is living here." She also called me a meadow girl and said in a snearing manner, "you expect to get a high position, as teacher, but I shall give you one rebuff." She very often made personal and scandalous remarks about my home and family, which remarks she made before the whole class and at last caused my mother to take me away from Miss Cunningham's class. Miller, sixteen years of age. being duly worn according to law upon her oath, deposes and saith, I live at number 21 Monroe street, in the City of Hoboken. I have attended school in Miss Cunningham's class at number 3 school during the September term of 1879, she made use of very vulgar and scandalous remarks about myself and the class in general, She called us the scum of the city, she called us hyenas she said, " she knew where we came from, we ragpickers, we came from Baxter street," which expression she made use of very frequently, she said it was a pitty that she had to breathe the same atmosphere with such low breeds as us," she said "teaching us was like stuffing turkey and dragging it out again." This abuse she, the said Miss Cunningham, kept up until I could not endure it any longer, and my father took me away from school. Bella W. Miller. Miss Cunningham, our teacher, has very often abused myself and our class, she called us the scum of the meadows, she called us idiots and she said, that my face and manners correspond with the neighborhood I live in. Miss Cunningham very often made use of low and vulgar expressions toward myself and her class in general She called me a monkey, she said brass was sticking out of my face, she called us paupers and the scum of the City, she also called us idiots. Trustee Reid offered the following: Resolved, That from December 1st, 1880, the salary of the janitor of School No. 4, be fixed at $100.00 per month during the time it may be necessary to heat the school, during the balance of the year the salary to remain as at present. On motion of Trustee Kiernan, laid over unto the next meeting. Trustee Kerr offered the following : Resolved, That the Committee on Supplies be directed to have the dictionaries now in the schools indexed with Dennison's patent index. On motion of Trustee Reid, adopted. Trustee Beltz presented a minority report in favor ol paying the claim of Patrick Sullivan, for $38.66. for services as Engineer School No. 4. On motion of Trustee Kiernan, the report was received and the claim ordered paid by the following vote: Ayes—Trustees Beltz, Havens, Kennedy, Kiernan, Kerr, Tangemann, Ingleson, McCulloch and President Munson. Nay—Trustee Reid. Absent—Trustees Anderson and O'Brien. Trustee Ke[r]r moved that the Committee on School Buildings and Furniture have Patrick Sullivan examined by the Inspector ot Engines, &c , ot the New York Police Board, and if he is found competent, appoint him Engineer of School No. 4, temporally. __Carried. Trustee Ingleson offered the following; Resolved, That the Clerk be instructed to draw on the Mayor and Council for the sum of $5,056.92, to pay the current expenses of the public schools for the month of November, 1880.
