Patrick Hayes, Jr., Chief of Police June 27, 1906 To the Mayor and Council, City of Hoboken, Gentlemen:- I respectfully suggest and recommend that your Honorable body, take immediate measures towards the passage of an ordinance, regulating the sale of fireworks and gunpowder, by retail dealers, in the corporate limits of the City of Hoboken. Section 247 of the recompiled ordinances, does not meet present conditions. It designates that period between the tenth of June and the tenth of July, when it is permissible to offer those articles for sale. This law is unreasonable and absurd and there can be no logical reason advanced in favor of it. It should be, therefore, eliminated from our books without delay, for it is due chiefly to this unwise liberality, that the people of our city are subjected to the head-splitting, nerve-racking noises, which they experience regularly at this season, and which from year to year, owing to the inventive genius of the manufacturer, is becoming greater and more intolerable. The police department have been active and earnest in their efforts to suppress this annual annoyance and have made many arrests as a result of their endeavors, but it would require a force of triple our present proportions and would demand their undivided attention, to properly cope with existing conditions, as the retail dealer is licensed to sell indiscriminately and is completely beyond our jurisdiction. Under the State Act of 1903, full and ample provision was made for regulating the sale of firearms, but afforded no aid in controlling the sale of fireworks and gunpowder. Should my request meet with your approval, I would further suggest, that the limitation for the sale of these articles, be reduced to the time intervening between the first day of July and the fifth day of July. Action has been taken by the authorities of neighboring municipalities in reference to this matter and it is only proper and due that similar action should be taken here.
