April 26, 1888 To the Board of Police Commissioners, Gentlemen, During the session of the Legislature of 1886 an Act was passed whereby the City authorities were enabled to increase the police force not to exceed sixty men, on the active list. In May, 1886, the force was thereby increased to fifty eight men; the appropriation for police purposes not warranting the limit of sixty men to be appointed. In 1887, the appropriation was also insufficient to make the increase, although the same was very much needed, and it was then agreed upon by the Commissioners that the two additional men should be appointed at the last meeting in April, of this year, to take effect on the first day of May, coming; so that the Tax Commissioners should be obliged to appropriate the amount required to support the full quota allowed by law, viz: sixty men. At your late meeting, the 25th instant, this was done by the appointment of John Cross and Thomas Barker, to take effect May 1st. At your meeting of the 23rd inst, Patrolman Kayser was placed on the retired lest, creating a vacancy on the active list, which was filled at your meeting of the 25th instant, by the appointment of Thomas Peters, to take effect June 1st, Prox. After these appointments were made, the Board of Police Commissioners, at said meeting, of the 25th, instant, by a vote of four to one, appointed John J. Stanton as a patrolman, to take effect May 1st, of the present year, making sixty one men on the active list of the force; a clear violation of law. In order to make this last action effectual, the Board, by a vote of four to one, passed a resolution placing Patrolman William Kerrigan on the retired list. This is also in violation of law, as the officer in question is not of the required age to be as placed and is still in good mental and physical condition. The officer was present at the meeting and, being called upon, asserted positively that he would not be sixty years of age until December 13th, of the present year. I would therefore most respectfully protest against your actions in the appointment of the said Stanton and the subsequent retirement of the said Kerrigan, as being violations of law and injustice to an old and faithful policeman.
